- Standard service fees and penalties for early termination
Standard service fees for the duration of the switch shall be the monthly recurring and consumption-based fees specified in the offer and order or the order via a plusserver web portal, which are incurred when using the data processing service.
As a penalty for early termination, plusserver, as a provider within the meaning of the Data Act, is entitled to demand and invoice the customer for a one-time penalty payment amounting to 90% of the fees agreed for the remaining contract term until the next possible termination date as compensation for early termination (Vorfälligkeitsentschädigung). - Jurisdiction governing the ICT infrastructure established for data processing by the individual services of plusserver
Federal Republic of Germany - General description of the technical, organisational and contractual measures taken by plusserver as a provider of data processing services to prevent international government access to or international government transfer of non-personal data stored in the Union if such access or transfer would be contrary to Union law or the national law of the Member State concerned:
plusserver has implemented a comprehensive concept of technical and organisational measures. These are in particular part of BSI C5 and ISO27001 certifications. In this regard, reference is made to the relevant certifications . The technical and organisational measures are also documented in the contract for order processing in accordance with Art. 28 GDPR. The special contractual conditions ‘pluscloud’ also contain corresponding provisions for dealing with investigation requests from government agencies for access to or disclosure of customer data. According to these provisions, plusserver will first verify the legal basis of such requests when investigating requests from government agencies for access to or disclosure of customer data In Germany, such powers are regulated in the laws of the Federal Criminal Police Office (Bundeskriminalamt) or the laws of the respective state offices, various procedural codes for courts and the laws for the intelligence services (German Law on the Federal Intelligence Service – Gesetz über den Bundesnachrichtendienst, BNDG; Federal Constitution Protection Act – Bundesverfassungsschutzgesetz, BVerfSchG; respective laws on the offices for the protection of the constitution of the states; German Law on the Military Counterintelligence Service – Gesetz über den militärischen Abschirmdienst, MADG) and the German G 10 Act (Artikel 10-Gesetz, G 10). Within the scope of what is legally permissible, plusserver will inform and involve the Customer upon receipt of such requests and will point out possibilities of objection. In case of encrypted data of the Customer, plusserver has in principle no possibility of decryption, except when plusserver or an engaged subcontractor also has access to a key, in particular depending on the respective product or management level. As a provider based in Germany, plusserver is not subject to the laws of any other country and therefore not subject to any international disclosure requests.
